<p>The watershed moment was Ryan Jenkins, who allegedly murdered his wife and was a contestant on reality show &#8220;Megan wants a Millionaire&#8221;  Jenkins passed an initial background check, apparently due to a Canadian court clerk missing filed cases.  Canada has since revised its background checking policies and tightened up it&#8217;s Canadian screening policies.</p>

			<content:encoded><![CDATA[<p>According to a <a href="http://www.newsday.com/long-island/nassau/pa-obama-threat-suspect-had-passed-background-checks-1.1545582?localLinksEnabled=false">newsday article</a>, a Newark airport security workers was arrested for allegedly making a shoot threat against President Barack Obama. He had been working for the security firm for six years, and had passed the mandatory FBI and 10 year <a title="Employment Background Checks" href="http://www.corragroup.com">employment background check.</a>  The article goes on to suggest that the background check wasn&#8217;t enough, and that the employer should have conducted psychological tests on the candidate.  However, they conceded, &#8220;It&#8217;s very hard to know what people are actually thinking&#8221;  The arrested security guard was apparently overhead making threats against the President on a coffee break the day before the President was going to fly into Newark.</p>
<p><strong>Recurring Background Screening</strong><br />
Usually a background check is a good indicator of future behavior, especially with regard to to anti-social behavior such as criminal activity or civil lack of fiduciary responsibility.  Sometimes an employee can come onto a job with a clean record.  However, as time goes on, your employee&#8217;s situation may change.  Its important to consider conducting additional background screening for your current employees, including those up for promotion.  Most trucking firms are required to evaluate <a title="CA Driving Records" href="http://www.corragroup.com/california-driving-records.html">driving records</a> over time, as their driver&#8217;s driving habits may change.  It is worth considering what sort of background check might be worthwhile for your firm to re-screen employees.    Make sure you follow the requirements of the FCRA, and obtain permission from your employees to run background checks.</p>

<p>Background checks are a valuable tool for screening offer ready candidates.  They can also be used to screen active employees, as the city of Alton is starting to do.  Before you begin to expand your screening practice to including ongoing checks of your current workforce, make sure you are in compliance with the Fair Credit Report Act.  You must always have your job applicants signed a consent and release form before running a background check.  If you are going to screen active employees, make sure that release form includes language giving you the right to screen again once the candidate has been hired.</p>
<p><strong>Recurring Screening<br />

<p><strong>Online vs. Paper?</strong><br />
If it wasn&#8217;t confusing enough, the USCIS notes that the current Form I-9 expires 06/30/09.  Today they issued a press release indicating that the form is still valid beyond June 30th.    They are requesting an extension from the OMB (office and management and budget) and until that occurs the form is still valid.  At some point they will have an updated form and will release it for employers to download.  When you sign up with a designated agent like Corra Group, their electronic form will automatically update with the new form, so there is no need to worry about expiration dates.</p>

<p><a title="Facis Search" href="http://www.corragroup.com/facis-search.html">FACIS stands for &#8220;Fraud and Abuse Control Information System&#8221; </a>which provides information on sanctioned individuals working in the healthcare field.  There are three levels of Facis. Level 1 combines the databases of the OIG and GSA, Level 2 adds a list of federal disciplinary action information from multiple agencies, and level 3, includes additional disciplinary actions from licensing and certification agencies across the country.</p>

			<content:encoded><![CDATA[<p>And you thought you were going to get the job right?  <a title="Background Checks" href="http://www.mercurynews.com/news/ci_10556762">Mercury News </a>has an article about how the Nevada Department of Public Safety inaccurately reported back minor misdemeanor crimes such as DUI records on thousands of individuals.   Apparently most of the searches were for Gambling-related companies, that probably must have a high standard for <a title="Criminal History Background Checks" href="http://www.corragroup.com">criminal history background checks</a> in order to meet federal and state compliance.</p>
<blockquote><p>The agency used a list of crimes not found in state laws to find that some applicants shouldn&#8217;t be hired. The list, which included misdemeanor DUIs and other minor crimes, was in a bill considered but not approved by the 2003 Legislature.</p></blockquote>
<p>The article touches upon the subject of application notifcation and whether the job applicants received an adverse action letter based on the background check. </p>

<p style="text-align: left;">Capt. Phil O&#8217;Neill, who runs the division, said he didn&#8217;t know of anyone who lost a job over the mistake, adding they might not have been hired for other reasons.</p>
</blockquote>
<p>This response sounds like code speak for &#8220;we found somebody better qualified&#8221; in which the company wouldn&#8217;t have to issue an adverse action letter.</p>

			<content:encoded><![CDATA[<p><a href="http://www.metronews.ca/halifax/local/article/86732">The College of Registered Nurses</a> of <a title="Nova Scotia Driving Records" href="http://www.corragroup.com/canada-motor-vehicle-records.html">Nova Scotia </a>will start requiring all prospective Nurses to conduct a $30 Canadian Criminal background check. The must pay for the background check themselves.  An honor system is currently inplace and all nurses must report any criminal offeneses on their annual renewal.  The college executive director thinks that requiring the prospective nurses to pay for their own background check is prohibitive and she feels that the honor system is working.  </p>
<p>We agree that having prospective candidates pay for their own background check may force them to apply elsewhere.   There is a shortage of nurses in the United States and Nova Scotia nurses may do well to travel south of the border. </p>
<p>We disagree that the honor system is working.  The honor systems works for those who do not commit crimes.  It is naive to believe that those nurses commit crimes, will honorably report all crimes on renewal.  The honor system, while high minded and should reflect the decency and civility of Nova Scotia, is subjecting medical patients to the &#8220;honor&#8221; of a criminal minded nurse.  By reductio ad absurdum, imagine a child molesting nurse.  Are we to believe that such a nurse would admit such crimes or convictions to the nursing college knowing that this information would assuredly ruin her chance to keep her job.   The college rightfully has instituted a <a title="International Criminal Records" href="http://www.corragroup.com/international-criminal.html">background check program </a>to protect the populace.</p>
